4 - CHANGES AND CANCELLATIONS (OF TOURS)
Changes from the side of the client
a) The client has the right to changing or cancelling a binding contract in writing, even on behalf of fellow travelers. CK will not get in contact with the co-travelers. Cancellation of the entire binding order results in the termination of the travel contract.
b) Cancellation of the binding order can be done 1 day before the start, at the very latest.
c) If the object of the order change is a change of date and CK can arrange it, then in addition to possible penalties, it is entitled to charge a handling fee of 500 CZK. If the object is an order change that involves a change in program or accommodation and CK can arrange it, then in addition to the possible penalties or payments, it is entitled to charge a handling fee of 500 CZK.
d) If the object of the order change is a change of the client, CK has the right to charge a handling fee in the amount of 500 CZK. The new client takes over all the rights and responsibilities to the extent that were agreed upon with the original client. The original and new client share equally in the payment of the ordered services and expenses related to the change.
e) If the object of the order change is a change of co-traveler, CK has the right to charge a handling fee in the amount of 500 CZK.
f) If there is a partial cancellation or a change or order in the sense of a decrease in the number of people occupying rooms, or the order of a means of transport and so on, the client is obliged to pay the difference in price (for example, 1 person reserved in a double room, or a higher price for a program in the event that there are fewer people).
g) In the case of a cancellation of a binding order, a part of the payment will be refunded within 14 days of the arrival of the cancellation in written form (by email or fax) to the bank account provided by the client after subtracting the following penalties:

h) The price of the order is understood as the full selling price of all the ordered services.
i) Time limits for giving notice of cancellation are counted from the day of providing written notice of the cancellation of the order by the client to CK, not including the starting day.
j) If during the tour the client or co-traveler cancel a part of the tour of their own accord or do not make full use of the ordered and purchased services, there are no grounds for financial compensation for these unused services.

Changes from the side of CK
k) CK has the right within 21 days before the start to unilaterally increase the price of ordered services in the event that there is an increase as follows:
- prices for transportation, including the price of fuel
- payments related to transportation that are included in the price of the tour
- currency exchange rates between the Czech crown and the other currency used for setting the prices in an average of over 10%
l) Written notice about the increase in prices will be sent by CK to the client at least 21 days before the start of the tour. These changes do not create grounds for the client to cancel the order.
m) If CK is forced to increase the price of a tour for reasons other than those given above, the client will be offered a change of contract. If the client does not object within 5 days of receiving this notice of change, it is taken that the client is in agreement.
n) If there are circumstances that prevent CK from providing the services as per the agreed conditions, CK is obliged to provide compensatory changes (such as in the program, itinerary, or prices) or cancel the order. CK is obliged to announce such changes to the client as early as possible.
o) The client has the right to withdraw from the contract and obtain a refund of the paid price or deposit without any penalties in the following cases:
- cancellation of the tour by the travel agency
- major changes in the program, itinerary, accommodation, transportation and price of the tour, except for the reasons stated in l); major changes are not considered changes in accommodation where the alternative is of the same or higher quality category, a change in the order of places visited on the itinerary, a change in the arrival/departure route for traffic, safety or other reasons.
p) CK reserves the right to cancel a tour if there are not a minimum number of participants listed in the particular tour; in the case of cancelling a tour, CK is obliged to inform the client at least 21 days before the start.
q) CK has the right to make operational changes to the program and obtained services during the tour if there are serious reasons for not being able to keep to the original agreed upon program. In such cases CK is obliged to:
- provide an alternative program and services in the scope and quality, and if possible the same as or similar to the original conditions, that is corresponding to the orientation of the tour;
- refund the client the paid price of services that were not provided, those for which no alternatives were provided;
- provide the client with a discount on the price of the service with were included into the price of the tour but were not provided to the full extent or quality;
r) If CK provides alternatives for services at the same or higher quality (for example, accommodation in a different hotel but at the same or higher quality level), no other compensation to the client will be provided by CK.
s) CK reserves the right to make material or time changes in the program for reasons that are affected by actions made by higher powers, for reasons of decisions made by government bodies or exceptional circumstances (emergency or uncertain security situation, strikes, traffic problems, misfortune, and other circumstances that CK was unable to influence or predict) and it does not take over responsibility for situations resulting from such changes in the tour program or prices.

5 - REFUNDS, LIABILITY AND DAMAGE
a) CK takes the utmost and continuous care in the updating of all presented information; however, in reality certain minor differences or changes may be incurred which cannot be subject to refunds.
b) In the event of incurring major differences where the scope or quality of the ordered services is lower than was agreed upon in the binding order, the client is obliged to contact CK as soon as possible (that is, during the holiday).
c) CK employees immediately try to solve the shortcoming. The client is obliged to provide the needed co-operation to correct the shortcoming so as to prevent possible damage or to minimize it. If this shortcoming cannot be corrected, the client then is entitled to a discount.
d) Possible refunds must always be requested in writing and sent to the address of CK. No consideration will be taken for refunds requested without contacting the client centre of CK. Telephoning the client centre of CK does not replace a written request for refund and will not be considered.
e) The client must make a written request for refund to CK without delay, or within 5 days of the end of the tour, in which the departure day is taken as the first day.
f) After the lapse of this time period, the client can make the complaint only if the delay was caused by reasons that were not the fault of the client; however, only to the limit of 3 months from the day the tour was to have ended according to the travel contract, otherwise this right is void.
g) The subject of possible refunds involves only unused services. This fact must be proven by the client (for example through the confirmation by the provider of the service).
h) The subject of an exchange or refund cannot be services that the client or co-traveler order themselves and therefore are not a part of the binding order.
i) If there are circumstances whose origin, duration or result isn't related to the activities or behaviour of CK (see major), or situations from the side of the client or his co-travelers on the basis of which the client or co-traveler wholly or partly do not make use of orders and purchased services provided by the travel agency, there is no right for the client or co-traveller to compensation or discount in price of such services.
j) If CK terminates a tour for reasons caused by higher powers, it is obliged to provide all the necessary transportation for the client to the final destination of the tour, unless otherwise agreed.
k) The first and last days of the program are mainly intended to provide transportation, transfers and accommodation; they are not meant as days of full program activity. For this reason, it is not possible to request a refund for a possible shortening of the stay or program.
l) CK is not responsible for any possible delays caused by technical reasons, bad weather, traffic, border crossings, strikes or other effects of higher powers. When planning the connections, holiday, shopping time, and such, the client and co-traveler must take possible delays into consideration. Even in the event of delays arising from incidents that are not the fault of the client or co-traveler, there are no rights to withdraw from the contract, or other discounts or compensation.
m) CK is not responsible for damage or losses caused by:
- the client
- a third party who was not connected to the tour
- an irreversible event that could not be prevented even in the event of making all the efforts that could be made.

6 - INSURANCE
Travel insurance for the client
a) The price of provided services does not include any travel insurance. Insurance must be arranged by the client individually. CK recommends that the client get insurance at least for tour termination, medical expenditures and responsibility for damage or loss.
b) In the case of insurance events, CK will provide the necessary co-operation, but will not cover the costs of medical treatment, etc. All costs must be covered by the insurance company.
Obligatory contract insurance of CK
c) CK has a contract with Ceska Pojištovna to provide insurance on the basis of which the client has rights to a claim in the following situations where CK is at fault:
- if it does not provide transportation for the client from the accommodation in the foreign country to the Czech Republic, if this transport is a part of the tour;
- if it does not refund the client the deposit or price of the tour in the event that the tour does not take place;
- if it does not refund to the client the difference between the paid price of the tour and the price of the partly provided tour in the event that the tour was only partially provided.
d) Demands of the client that arose from shortcomings of the travel agency as a result of not fulfilling the travel contract, being passed on to the insurance company to the point of fulfillment that the insurance company provided.
e) Proof of this compulsory insurance will be shown by CK on the request of the client, in that this document is valid only in conjunction with the confirmation of the payment of provided services. A view of the proof of completing the insurance contract is HERE .
